Zapmail Affiliate Program Terms of Service

Welcome to the Zapmail Affiliate Program. By participating in our affiliate program, you agree to comply with and be bound by the following terms and conditions. 

Please review the following terms carefully. If you do not agree to these terms, you should not participate in the program.

1. Enrollment in the Program

To begin the enrollment process, you must complete and submit the online application. We will evaluate your application and notify you of your acceptance or rejection. We reserve the right to reject any application at our sole discretion.

2. Affiliate Responsibilities

As an affiliate of Zapmail, you agree to:

• Promote Zapmail and its services to your audience in a legal, ethical, and professional manner.
• Use only the approved marketing materials provided by Zapmail.
• Avoid any misleading or deceptive advertising practices.
• Comply with all applicable laws and regulations, including but not limited to those related to email marketing and data protection.

3. Prohibited Activities

Affiliates are strictly prohibited from:

• Engaging in any form of fraud or unethical behavior, including but not limited to cookie stuffing, cloaking, or using bots.
• Making false claims or representations about Zapmail’s products or services.
• Engaging in self-referrals or referring yourself, your business, or anyone in your household.
• Using spam or unsolicited commercial emails to promote Zapmail.

4. Earnings and Payouts

• Commission Rate: Affiliates will earn a 10% commission on the first purchase made by each referred user.
• Lifetime Earnings: The 10% commission will apply to the first purchase for the lifetime of the referred user.
• Payout Schedule: Commissions will be paid out on NET 60 (2 months after the referral), provided the affiliate’s balance has reached the minimum threshold of $25. If the balance is below $25, the balance will roll over to the next month.
• Payment Method: Commissions will be paid via Wise or Paypal. Affiliates are responsible for providing accurate payment information.
• Refunds and Chargebacks: If a referred user’s purchase is refunded or charged back, the corresponding commission will be deducted from the affiliate’s balance.

5. Term and Termination

• Term: This agreement will begin upon our acceptance of your affiliate application and will continue until terminated.
• Termination: Either party may terminate this agreement at any time, with or without cause, by giving the other party written notice. Upon termination, the affiliate must cease using all marketing materials provided by Zapmail and remove all links to our site.
• Consequences of Termination: Upon termination, the affiliate will forfeit any unpaid commissions if the termination was due to a violation of these terms.

6. Confidentiality

Affiliates agree to keep all information related to Zapmail and its affiliate program confidential. This includes, but is not limited to, commissions, conversion rates, and marketing strategies.

7. Limitation of Liability

Zapmail will not be liable for any indirect, incidental, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this agreement, even if Zapmail has been advised of the possibility of such damages.

8. Indemnification

Affiliates agree to indemnify and hold harmless Zapmail and its employees, directors, and representatives from any claims, damages, liabilities, or expenses arising from the affiliate’s participation in the program, including any breach of this agreement.

9. Modifications to the Terms

Zapmail reserves the right to modify these terms at any time. Affiliates will be notified of any changes via email. Continued participation in the program after any such changes shall constitute the affiliate’s consent to such changes.

10. Miscellaneous

• Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles.
• Severability: If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
• Entire Agreement: This agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements and understandings.

By submitting your application to become an affiliate, you acknowledge that you have read this agreement, understand it, and agree to be bound by its terms and conditions.
